Avoiding Foreclosure on a Colorado House
If you are behind on payments in Colorado, the most useful thing to understand is the clock. Colorado foreclosures run through the county public trustee, and the timeline is defined by statute rather than by your lender’s mood. Knowing where you are in it tells you what options you still have.
The Colorado public trustee timeline
- The clock starts when the Notice of Election and Demand is recorded — not when you miss your first payment. Missing payments comes months earlier.
- The sale is typically scheduled 110 to 125 days after the NED is recorded.
- The public trustee mails a combined notice within 20 days of recording, mails again 45 to 60 days before the sale, and publishes once weekly for five consecutive weeks.
- A court order under Rule 120 is required before the sale can happen. Notice is posted on the property at least 14 days before the hearing, and you have until 7 days before the hearing to file a response. If you do not respond, the order enters.
- To cure (reinstate) the loan, a Notice of Intent to Cure must be filed no later than 15 calendar days before the sale date. Cure funds generally have to reach the public trustee by noon the day before the sale.
- The sale can be continued, up to 12 months from the original date, and the lender can withdraw the NED at any time before the sale.
The most important thing: you can usually still sell
Because a lender can withdraw the foreclosure at any point before the sale, a closing that pays the loan off in full stops it. Practically, that means the window to sell runs almost to the auction date — provided a title company can get a payoff and the transaction can actually close in time.
What closes that window permanently is the sale itself. Colorado does not give the homeowner a right of redemption after a public trustee sale. Post-sale redemption under CRS 38-38-302 belongs to junior lienholders, not to the owner. Once the auction happens, selling is no longer an option. This is the single most misunderstood fact in Colorado foreclosure, and it is the reason calling early matters so much.
Your realistic options
- Reinstate. Pay the arrears and fees to bring the loan current, using the Notice of Intent to Cure process above.
- Loan modification, forbearance or a repayment plan with your servicer. Start this early; it takes time.
- Refinance, if you have equity and your credit still supports it.
- List the house, if you have equity and enough runway. If you have four to six months and the house is market-ready, listing will usually put more in your pocket than any cash offer, and we will tell you that.
- Sell directly for cash, when time is short, the house needs work, or a financed buyer’s loan falling through would be catastrophic for you.
- Short sale, if you owe more than the house is worth. This requires lender approval and takes longer.
